O R D E R
(Thro' VC) This Criminal Original Petition is filed to transfer the investigation in Crime No.1210 of 2017 on the file of the 2nd respondent police to the 3rd respondent police or any other agency, based on the representation, dated 30.1102017. 2.According to the prosecution, the complainant went to Chennai for medical treatment since 2002 and at the time, the accused was introduced and accustomed to friendship and they accompanied with 1/3
construction business in the name of Karthick Builders and Meenakshi Builders and in the business, the accused forged the amount and when the same was questioned, he threatened the complainant with dire consequences.
3.When the matter is taken up for hearing, the learned Government Advocate (Criminal side) appearing for the respondents submitted that in this case, the investigation in Crime No. 1210 of 2017 has been completed by the 2nd respondent and the charge sheet is going to be filed before the concerned court and at this stage, there is no need to transfer of the investigation to the 3rd respondent.
4.The said fact is not disputed by the learned counsel appearing for the petitioner and he requested that direction may be given to the trial court to dispose of the case within a short period of time.
5.Recording the above, this criminal original petition is dismissed with a direction to the trial court namely the Judicial Magistrate No.5, Madurai, to take up the case in connection with a case in Crime No.1210 of 2017 on its file and thereafter, post the case on day today basis and dispose of the same, purely on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.
