ORDER : The Court made the following order :- The petitioner/accused No.1, who apprehend arrest at the hands of the respondent 1/3

police for the offences punishable under Sections 126(2), 296(b), 115(2), 351(2), 303(2) of BNS Act in Crime.No.216 of 2024, seeks anticipatory bail. 2.The case of the prosecution is that due to previous enmity the petitioner and others quarreled and attacked the de-facto complainant with an iron rod and also had taken away his ATM card, Rs.6700/- cash and mobile phone worth 19,500/-. Hence, the complaint.

3.The learned counsel appearing for the petitioners submitted that the complaint itself had been lodged belatedly with huge delay and nothing was taken away by the petitioner from the de-facto complainant. He further submits that the petitioner has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and he prays for granting anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the petitioner is a habitual offender and having 6 previous cases and prays for dismissal of this petition. 5.Considering the nature of the allegations and the fact that the petitioner is a habitual offender having 6 previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
