Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to hand over the original passport bearing No.N9481010145 and original National Identity Card to the petitioner, so as to enable travel France based on the petitioner's representation dated 27.09.2024. ORDER

The present Writ Petition is filed for Mandamus directing the respondents herein to hand over the original passport bearing No.N9481010145 and original National Identity Card to the petitioner based on the petitioner's representation dated 27.09.2024.

2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, takes notice for the respondents. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

It is reported by the learned Additional Public Prosecutor that the petitioner's passport was seized as a case property in Crime No.1 of 2019 for the offences under Sections 120B, 420, 465, 468, 471 of IPC, Section 12(1A) (a), 12(1A)(b) and 12(2) of Passport Act, 1967 on the file of the second respondent and the same is now in the custody of the Judicial Magistrate No.IV, Madurai. Hence, the petitioner may be directed to approach the concerned Judicial Magistrate for return of passport.

4. Recording the above submission, this Writ Petition is disposed of. The petitioner shall approach the concerned Judicial Magistrate for return of her passport.
