ORDER

This petition has been filed seeking to quash the proceedings in D.V.C.No.122 of 2016 on the file of the learned Additional Mahila Court (Judicial Magistrate Level), Tirchy.

2. It is seen from the records that from the year 2017 onwards the learned counsel for the petitioners has never argued this case before this Court and it has been repeatedly adjourned. The case has not even admitted by this Court from 2017. Subsequently, there is a change in counsel representing the petitioners and he was also not present before this Court.

Taking into consideration the facts and circumstances of the case, this Court is of the considered view that the grounds raised by the petitioners are all based on merits and the same requires appreciation of the evidence. However, the presence of the petitioners 2 to 9 are dispensed with and they shall be permitted to be represented through a counsel. The first petitioner shall be present before the Court below on every date of hearing. 3.This Criminal Original Petition is disposed of with a direction to the Court below to complete the proceedings in D.V.C.No.122 of 2016, on the file of the learned Additional Mahila Court (Judicial Magistrate Level), Trichy, within a period of three months from the date of receipt of a copy of this order. Consequently, the connected miscellaneous petitions are closed.
