ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 6(b), 24(1) of Cigarette and other Tobacco Products Acts of 2003 and Section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015, seeks anticipatory bail.
2. The case of the prosecution is that on 05.08.2024, at about 09.00 A.M., the defacto complainant and his team were on patrol duty, at that time, they noticed that the petitioner along with other accused persons were found to be in illegal possession of prohibited tobacco products and the accused persons sold the same to the school going children. Hence, the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for anticipatory bail.
4. The learned Government Advocate (Criminal Side) appearing for the respondent Police would submit that the respondent Police recovered 408 packets of 2/4
tobacco products from the accused persons. Hence, he vehemently opposed to grant of anticipatory bail to the petitioner.
5. Considering the nature of allegations in this case that the petitioner along with other accused persons were found to be in illegal possession of tobacco products including cool lip, which were supposed to be supplied to the tender children, this is not a fit case for enlarging the petitioner on anticipatory bail.
