PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To release the Petitioner on bail relating to the case in S.C.No.118 of 2015 on the
file of the Principal District and Sessions Judge, Sivagangai, in Crime No.333 of 2000 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A2, who is facing a case for the offence under Sections 147, 148, 341, 324, 506(II), 307 and 302 of IPC @ 147, 148, 341, 506(II), 307, 34, 302 and 149 of IPC in S.C.No.118 of 2015 on the file of the Principal District and Sessions Judge, Sivagangai, in Crime No.333 of 2000 on the file of the respondent police, seeks bail. 2.The petitioner was absent during the trial in S.C.No.118 of 2015 on the file of the Principal District and Sessions Judge, Sivagangai and the petitioner was arrested on 01.09.2024. From onwards, he is in judicial custody. Hence, the petition.
3. Heard both sides.
4. Considering the fact that the occurrence happened 24 years ago in the year 2000 and the matter is pending only for the absence of the petitioner and the other accused repeatedly and the case has been split up and is pending and the petitioner being arrested only recently on 01.09.2024 and further considering the submissions that the trial in this case consisting of 22 witnesses can be completed within a period of two months, I am not inclined to enlarge the petitioner on bail.
5. Accordingly, this Criminal Original Petition stands dismissed.
6. Considering the fact that the petitioner's request for bail is dismissed, the prosecution shall produce the witnesses without fail on their respective dates, and a
