This Petition filed under Section 482 of Criminal Procedure Code, to direct the Learned Additional District and Sessions Judge for PCR Court, Sivagangai to consider the petitioner's bail petition on merits upon the petitioner surrender before the said court and enlarge the Petitioner on bail on the same day. ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. R. Velmurugan, Advocate for the Petitioner and of Mr. R. Suresh Kumar, Government Advocate for the respondents 1 & 2, this Court made the following order: Crl.O.P.(MD) No.15637 of 2022 had been filed to direct the learned Additional District and Sessions Judge for PCR Court, Sivagangai to consider the Petitioner's bail petition on merits upon the Petitioner's surrender before the said Court and enlarge the Petitioner on bail on the same day in connection with Crime No.256 of 2022 on the file of the second Respondent. https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD). No.13890 of 2022 2.Crl.O.P.(MD) No.15637 of 2022 was disposed of by this Court, vide order dated 30.08.2022, granting two weeks time to the Petitioner to surrender before the learned Additional District and Sessions Judge for PCR Court, Sivagangai, from the date of receipt of a copy of the order. After grant of the order, the Petitioner suffered from fever. Therefore, he was unable to surrender before the learned Additional District and Sessions Judge for PCR Court, Sivagangai, within the time specified in the order dated 30.08.2022 in Crl.O.P.(MD) No.15637 of 2022. Therefore, now the Petitioner had filed Crl.M.P.(MD)No.13890 of 2022 to extend the time limit of the Petitioner to surrender before the learned Additional District and Sessions Judge for PCR Court, Sivagangai.
3.Considering the explanation offered by the learned Counsel for the Petitioner, this Petition is allowed, granting two weeks further time to the Petitioner from the date of receipt of a copy of this order to comply with the conditions imposed upon the Petitioner in Crl.O.P(MD) No.15637 of 2022 dated 30.08.2022.
