ORDER : The Court Made the following order :- The petitioners who are arrayed as accused 5, 8 and 11 in Crime No.5 of 2017 on the file of the respondent police for the offences under Sections 147, 148, 341, 294(b), 302 IPC & Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act read with Section 3(1)(r)(s) & 3(2)(Va) of the SC/ST (POA) Act, seeks bail. 2.One Saravanaraja was murdered due to political enmity. The defacto complainant is the wife of the deceased person who has witnessed the bruised murder and has given a detailed information about the assailants. Based on her information, the police has investigated and arrested these petitioners.
3.The learned Government Advocate(Crl. Side) submits that these petitioners at the instigation of one Dhanasekaran who is arrayed as A1, have armed with lethal weapons and brutally attacked the deceased when he and his wife dropped their children at school and were about to take their car. Further, the investigation indicates that these petitioners as hirelings to A1 are involved in this crime and they https://hcservices.ecourts.gov.in/hcservices/
have also committed more heinous crimes which are pending trial. 4.Taking note of the above objection made by the learned Government Advocate(Crl.Side), and the manner and place in which the crime is committed, this Court is of the opinion that these petitioners do not deserve any consideration for granting bail.
