ORDER : The Court made the following order :- The petitioner / sole Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 77 and 351(3) of BNS r/w 66 E of Information Technology Act, in connection with Crime No.272 of 2024, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 03.10.2024, when the defacto complainant was taking bath, the petitioner / sole accused is said to have taken photographs in his cell phone and threatened her by stating that he will upload the photo in the social media. Hence the complaint.
3. The learned counsel for the petitioners submits that another case was also lodged for the assault made by the defacto complainant. On that motive, the false case has been registered.
4.The learned Government Advocate(Crl.side) appearing for the respondent submits that the petitioner has taken videograph of the defacto complainant while she was taking bath. Further, the petitioner is having bad antecedents and in the year 2023 itself two cases have been registered for the offences under the SC/ST (POA) Act and under Section 506(2) of IPC.
5. Considering the facts and circumstances of this case and also the fact that the petitioner is having previous cases, this Court is not inclined to grant anticipatory bail 2/3
to the petitioner.
