Mr.B.Thanga Aravindh Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL UNDER SEC 482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.274 of 2024 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 329(4), 296(b), 351(3), 305(a) of BNS 1/3

and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, in connection with Crime No.274 of 2024, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 08.09.2024, the petitioners / A1 to A3 quarrelled with the employee of the defacto complainant and a complaint was made before the North Police Station, Rajapalayam. Due to such enmity, the petitioners have entered into the defacto complainant's poultry farm and they have taken away 4 sheep, 10 Chicken and 20 pigs worth about Rs.2,50,000/-. Hence the complaint. 3.The learned counsel for the petitioners submits that due to business motive, a false case has been lodged and the petitioners have not taken any properties as alleged by the prosecution.

4.The learned Government Advocate(Crl.side) appearing for the respondent submits that in this case Accused No.4 was arrested and it is revealed that the petitioners herein have also participated in the occurrence and all the livestock have already been sold to the butcher shop.

5.Considering the facts and circumstances of this case and also the fact that the Accused No.4 was arrested and high valued livestock have been taken away by the petitioners and they have not been recovered so far, this Court is not inclined to grant anticipatory bail to the petitioners.
