PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondents 1-3 not to indulge in Kattapanchayat under the guise of enquiry and further not to interfere in the petitioner's civil dispute.

ORDER

This Criminal Original Petition has been filed to direct the respondents 1-3 not to indulge in Kattapanchayat under the guise of enquiry and further not to interfere in the petitioner's civil dispute.

2. Now the grievance of the petitioner is that on 18.09.2023, she has summoned by the first respondent in the complaint given by her husband and it was closed. Further, she was orally summoned and harassed to hand over the possession to the private respondents.

3. The learned Government Advocate (Crl.Side) would submit that no such oral summon was issued to the petitioner and no harassment is made by the official respondents herein. The complaint given by the husband of this petitioner came to be closed on the basis of the undertaking given by the petitioner on 22.09.2023. There is no further enquiry pending with the official respondents.

4. Since no enquiry is pending before the second respondent, nothing survives for futher consideration or direction in this matter. If the 2/4

petitioner still got any grievance, she can workout her remedy through appropriate proceedings. There is no question of reopening the above said complaint.

5. In view of the submissions made by the learned Government Advocate (Crl. Side), this Criminal Original Petition is dismissed as infructuous.
