PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the second respondent herein to execute the non bailable warrant against the third respondent issued by the Family Court in Crl.M.P No. 223 of 2017 dated 21.12.2018. ORDER

This petition has been filed seeking direction to direct the second respondent herein to execute the non bailable warrant against the third respondent issued by the Family Court in Crl.M.P No. 223 of 2017 dated 21.12.2018

2. The petitioner is the wife of the third respondent, who filed maintenance case in MC No. 5 of 2014 on the file of the Family Court, Madurai. Maintenance was granted in favour of the petitioner. Even then the third respondent did no comply with the order passed by the Family Court. Therefore to execute maintenance award she filed petition in Crl.M.P No. 223 of 2017. Even after receipt of notice, the third respondent did not appear before the Family Court. Hence the Family Court issued Non Bailable Warrant as against the third respondent and the same is pending on the file of the second respondent.

3. Considering the above facts and circumstances of the case, the second respondent is directed to execute the Non Bailable Warrant as against the third respondent in MC No. 5 of 2014 on the file of the Family Court, Madurai within a period of four weeks from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/ 1/2
