Respondents ( 6th respondent is suo motu impleaded vide order of this Court dated 21.11.2024 in W.P(MD) No.23651 of 2023) PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records of the impugned order of suspension in proceedings in Ref.No.3535/A1/2022, dated 11.04.2022 on the file of the third respondent herein and quash the same as illegal and pass appropriate orders in the light of the judgment passed in Ajaykumar Choudry - Vs- Union of India and another reported in 2015 (7) SCC Page 291 by considering the petitioner representation on 26.07.2023, in accordance with law.

The present Writ Petition has been filed by a Driver working in the third respondent Office, challenging the order of suspension dated 11.04.2022.

A perusal of the suspension order reveals that the petitioner has been implicated in a criminal case in Crime No.11 of 2022, dated 08.04.2022 on the file of the Inspector of Police, City Crime Branch (CCB), Madurai City, Madurai, on the allegations of job racketing. The petitioner was placed under deemed suspension, in view of the fact that he was under judicial custody for more than 48 hours.

3. The learned Government Advocate appearing for the respondents submits that the enquiry has been completed on 11.11.2024 and the final order would be passed by the District Health Officer, Madurai District.

4. Considering the fact that the enquiry has been completed, this Court directs the District Health Officer, Madurai District to pass final orders in the enquiry within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
