ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 08.05.2024 for the offences punishable under Section 376(3), 363 of IPC and Sections 5(l) 5(k) r/w. Section 6 of POCSO Act, 2012, in Crime NO.14 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused has forcibly taken the victim girl, who is mentally disabled and aged about 15 years and committed penetrative sexual assault. Hence, the complaint. 3.Heard the learned counsel on either side and perused the material records of the case.

4.Considering the nature of allegation in this case that the petitioner along with the other accused are said to have committed penetrative sexual assault on the victim child, who is a person with intellectual disability, this is not a fit case for grant of bail.

5.Since the petitioner's application for bail is rejected and it is stated that now the matter is posted on 22.10.2024 for furnishing copies, it is for the prosecution to take such steps to complete the trial as expeditiously as possible.
