ORDER

This petition is filed by the accused in C.C.No.1140 of 2015 pending on the file of the learned Judicial Magistrate, Kuzhithurai at Kanyakumari District against the proceedings initiated by the respondent / complainant as against this petitioner, for the offence under section 138 NI Act.

2.When the matter is taken up for hearing today, the learned Counsel for the petitioner as well as the respondent submitted that the petitioner / accused died and he is no more and therefore, no useful purpose would be achieved by keeping this petition pending and they have also made an endorsement to that effect.

3.In view of the submissions and the endorsement made by the learned Counsel on either side that the petitioner is no more, this petition is closed. Consequently, connected miscellaneous petitions are closed.
