For Petitioner :Mr.J.Madhu For R1 to R3 :Mr.B.Thanga Aravindh Government Advocate (Criminal.side) **** O RDER This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking for a direction to the respondent police to provide protection basing on the representation of the petitioner dated 12.09.2023. 2.It is submitted by the learned counsel for the petitioner that the petitioner is the owner of the landed property bearing S.F.No.178/1, 169/5, 178/9C, 178/9B, 176/2, 76/1A2, 76/2, 175/1, 170/9, 170/8, 176/8, 165/9 at Arivithi Vilage, Thiruvadanai Taluk, Ramanathapuram District. The respondent Nos.4 and 5 are the brothers of the petitioner and there are disputes between them. 3.The learned Government Advocate (Crl.side) submits that the petitioner has earlier filed an application and the same was registered as CSR.No.255 of 2023 and that was enquired into and during the course of enquiry, the petitioner 2/5

has given an undertaking in writing duly signed submitting to the police that he will approach the civil Court and resolve the dispute. The petitioner has also filed O.S.No.27 of 2013 on the file of the District Munsif Court, Thiruvadanai seeking declaration and permanent injunction and the same is pending. 4.Since the application filed by the petitioner was already closed and the suit filed by the petitioner is still pending in the civil Court, no further orders can be passed in this petition. Accordingly, this Petition is disposed of.
