ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.4 and 5, in Crime No.180 of 2017 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 363 and 506(ii) of IPC and hence, seek anticipatory bail.

2. Heard the learned counsel for the petitioners and the learned Government Advocate(Crl.Side) for the respondent/State as well as learned counsel appearing for the intervener.

3. When the matter was taken up for hearing, the respective counsels submitted that today they have arrived at a compromise between them. They have also filed a joint memo dated 28.04.2017 to that effect duly signed by both the parties.

4. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the investigation is pending.

5. Considering the facts and circumstances of the case and in view of the joint memo filed by both parties, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.1, Dindigul and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) https://hcservices.ecourts.gov.in/hcservices/

with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police twice in a week i.e. on every Saturday and Sunday at 10.30 a.m until further orders. The petitioners shall also comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
