O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to issue Non-traceable Certificate for the petitioner's sale deed document on the basis of the complaint given by the petitioner dated 07.09.2023 within a time frame as fixed by this Court .

2. Mr.R.M.Anbunithi, learned Additional Public Prosecutor takes notice for the respondents.

3.Heard both sides.

4. The learned counsel appearing for the petitioner would submit that the petitioner has lodged a complaint before the second respondent to find out his missing original sale deeds Document No.615 of 1960 and 619 of 1960 and 613 of 1960 and one promissory note executed by one Malaiyandi. He would further submit that the petitioner has also made paper publication on 09.09.2023 with regard to the missing of original documents.

4. The learned Additional Public Prosecutor would submit that due to non availability of sufficient documents, further process could not be completed.

5. Considering the submissions made by the both sides, let all the documents be produced by the petitioner before the second respondent. The second respondent Police is directed to conduct enquiry ensuring the said documents have not been deposited for any purpose, following the circular issued by the Director General of Police within a period of three months from the date of receipt of a copy of this order. Depending upon the outcome of the above said enquiry, the petitioner can workout his remedy through appropriate proceedings, if not satisfied.

5. With the above direction, this Writ Petition stands disposed of. No costs.
