Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order issued by the 2nd respondent in Na.Ka.No. 4554/2022/KA dated 30.06.2022 and quash the same in so far as conditional retirement i.e. allowing the petitioner to retire from service without prejudice to pending surcharge proceedings in Na.Ka.No. 1214/2019 Sa Pa dated 30.05.2019 and consequently directing the respondents to pay the Death Cum Retirement benefits encashment of earned leave and other monetary benefits more fully regular pension within the time stipulated by this Court.
ORDER : This Sub Application Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.P.VEERA KATHIRAVAN, Additional Advocate General assisted by Mr.P.T.THIRAVIYAM, Government Advocate on behalf of the petitioner and of Mr.C.JEGANATHAN, Advocate on behalf of the 1st Respondent, the court made the following order:- The proposal with regard to the commutation, gratuity and pension, had already been sent from the office of the Joint Registrar of Co-operative Societies, Thanjavur, to the Accountant General Office and the same is pending before the 2/4
Accountant General.
