ORDER

This petition has been filed seeking mandamus directing the first respondent to issue the passport to the petitioner considering the application in File No.TR1075385245825 dated 24.07.2025 within the time stipulated by this Court.

2. It is the case of the petitioner that he has applied for issuance of passport before the first respondent on 24.07.2025 vide File No.TR1075385245825. The petitioner has also attended interview. Thereafter, the petitioner was issued a letter vide Objection Reference No.OBJ/1049806106125 calling upon him to clarify regarding the adverse report received from the first respondent alleging that he was involved for an offence under Section 436 of IPC in Crime No.37 of 2020 dated 17.03.2020. The petitioner has also given explanation to the first respondent through representation dated 25.08.2025. However, the petitioner's application for issuance of passport has not been considered and hence, he has approached this Court by filing the above writ petition.

3. The learned Government Advocate (crl.side) appearing for the second respondent, on instructions, would submit that the petitioner is arrayed as accused in Crime No.37 of 2020 and the final report is yet to be filed. That apart, two previous cases are pending against the petitioner.

4. Heard the learned counsel on either side.

The learned Government Advocate (Crl.side) has submitted that there are serious allegations made against the petitioner, that he and others had set fire to the house the defacto complainant, though a final report is yet to be filed. Therefore, the application of the petitioner seeking issuance of passport cannot be considered at this stage and the same shall be considered only after the necessary orders are obtained from the Criminal Court acquitting the petitioner as if the complaint is closed against the petitioner. Accordingly, this Writ Petition is dismissed. No costs.
