PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus and direct the respondents 1 and 2 to secure the detenue namely Lakshmi, D/o.Ramasamy aged about 35 years and produce before this Court and set her at liberty to petitioner. For Petitioner :

The petition has been filed complaining that his wife Lakshmi is missing on and from 17.02.2024.

2. The matter had been actually adjourned to 11.11.2024. A mention had been made by the learned Additional Public Prosecutor that the detenue had been secured.

3. We enquired with the detenue. She stated that she had taken a voluntary decision to stay in a Home and would take one week time to reflect upon the decision taken by her. She is doing some work in the Home namely to pack Agarbathis. She had clearly mentioned her decision. After hearing the petitioner, we are of the opinion that both of them will have to take a decision before an alternate forum and not before this Bench relating to their marital life. We are satisfied that the detenue is not in illegal custody.

4. No further orders are required to be passed. Hence the petition stands closed.
