ORDER

The present Review Application has been filed seeking to review the order dated 13.07.2022 made in W.P(MD) No.12606 of 2012, wherein this Court has directed the writ petitioner to deposit the maintenance amount on or before 15.10.2022. The said order was passed based upon the undertaking given by the learned counsel appearing for the writ petitioner.

2. The review application has been filed with a contention that the counsel was not authorised to give such an undertaking. The Review applicant has filed an affidavit. Paragraph No.10 of the affidavit is extracted as follows:

"10. I state that I am a destitute widow, raising three female children and one male child, the Property against which the said Impugned Auction Proceedings is my dwelling house and small agriculture land, wherein I and my Children 2/5

currently live. Hence citing my current circumstance, it would be of great relief to me, if I am permitted to pay the requisite amount as per this undertaking, with some more grace time. To that effect I am filing this Undertaking affidavit, wherein I undertake that the amount of Rs.1,30,500/- to remit before the learned Judicial Magistrate, Orathanadu in C.M.P.No.1706 of 2007 within a period as would be stipulated and ordered by this Hon'ble Court in this Rev.APLW (MD) No.134 of 2023".

In view of the above said affidavit filed by the review applicant/ writ petitioner, this Review Application stands disposed of, granting time till 28.02.2026 for remitting a sum of Rs.1,30,500/- (Rupees One Lakh Thirty Thousand and Five Hundred only) before the learned Judicial Magistrate, Orathanadu in C.M.P.No.1706 of 2007. Till such deposit is made, the revenue recovery proceedings shall be kept in abeyance. On payment of the said amount the revenue proceedings shall stand set aside. 3/5
