ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 27.07.2024 for the offences punishable under Sections 328 and 379 IPC in crime No.33 of 2020 on the file of the respondent police, seeks bail.

2. Heard the learned counsel for the petitioner and the learned Additional 1/3

Public Prosecutor appearing for the respondent and perused the materials available on record.

3. Considering the nature of allegation against the petitioner that the petitioner said to have spiked the cool drink of a fellow passenger in the train and decamped with the jewels and considering the allegation that NBW was issued against the petitioner on 17/3/2021 as he was absconding for more than three years and was arrested after forming special party, I am of the view that this is not a fit case where the petitioner can be enlarged on bail since there is a reasonable apprehension that the petitioner will again abscond.

4. In view of the fact that the petitioner's prayer for enlarging the petitioner on bail is rejected, the prosecution is directed to expedite the trial and a copy of this order shall also be placed before the trial court so as to expedite.

5. With the above observation, this Criminal Original Petition is dismissed.
