ORDER

This writ petition has been filed directing the 1st respondent to re-issue the passport of the petitioner in Application reference No.TR1075424609725, dated 31.07.2025.

Heard Mr.V.Dinesh Kumar, learned counsel for the petitioner and Mr.T.Leninkumar, learned counsel for the first respondent and Mr.S.Prakash, learned Government Advocate [Crl side] for the second respondent.

It is the contention of the petitioner that since the adverse report received from the second respondent, the application of the petitioner for reissuance of passport has not been acted upon by the first respondent so far. Further it is stated that he has not involved in any offence as alleged by the second respondent.

4. The learned Government Advocate (Crl.side), on instructions, would submit that there are six criminal cases are pending against the petitioner at the FIR stage.

5. In the considered view of this Court, the law on this issue is now too well settled. As per the decision of the Division Bench of this Court in The Regional Passport Officer, Chennai vs. Samsudeen Mohamed Salih and another (W.A. No.902 of 2023 dated 02.06.2023), there can be no impediment to direct the first respondent to process the passport application of the petitioner. Hence, there shall be a direction to the first respondent to process the application of the petitioner and re~issue the passport in the name of the petitioner within a period of two months from the date of receipt of a copy of this order, if the petitioner satisfies all the other requirements.
