PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to survey and demarcate the petitioner's land comprised in S.No.230/3B1New Town Survey No. 10/3B1A, Block No.3, Ward F, Aruppukottai Town, Virudhunagar District, Measuring 0.1800.0 hectares, by considering his application dated 05.03.2025 within a time frame that may be stipulated by this Court. 1/4

ORDER

After submitting an application dated 05.03.2025 seeking a survey of the land in New Town survey No.10/3B1A, the present writ petition has been filed. 2.Learned counsel for the petitioner relies on sale deed dated 02.02.1996 and the patta at page No.21 of the typed set. 3.Both learned Additional Government Pleader and learned Standing Counsel for the third respondent submit that they endeavoured to conduct the survey by issuing a notice to the petitioner and to the President of the Nithyanandam Swamy Kovil Trust. It is further stated that the said Trust has put up a gate and fence barring access to the relevant land. Learned Additional Government Pleader submits that the inquiry shall be conducted after putting all the affected parties on notice.

4.Accordingly, this writ petition stands disposed of by directing the respondents to conduct an inquiry in relation to the petitioner's application dated 05.03.2025 by providing a reasonable opportunity to the petitioner and the Nithyanandam Swamy Kovil Trust and thereafter issue a speaking order within twelve weeks from the date of receipt of a copy of this order.
