ORDER : This Court made the following order :- The petitioners / Accused Nos.1 & 2, who were arrested and remanded to 1/6
judicial custody on 05.08.2025 for the offences punishable under Sections 296(b), 115(2), 324(4), 351(3) of BNS and r/w.Section 4 of TamilNadu Prohibition Harassment of Women Act and section 20 and 25(1A) of Arms Act, 1959 in Crime No.261 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that in the year 2016, the defacto-complainant married one Manikandan and due to marital wedlock they have got female child. Thereafter, due to misunderstanding in the year 2021, the defacto-complainant divorced by her husband. After that the defacto-complainant lived with her parents house along with her child. Thereafter, she had relationship with the first petitioner/first accused. In the meantime, the defacto-complainant's family members were arranged marriage to the complainant. Hence, the first petitioner came to the defacto-complainant's house and used filthy language against the defacto-complainant and slapped her cheek and assaulted her parents and other accused persons caused damages and threatened them with dire consequences. Hence, the case.
3. The learned counsel for the petitioners would submit that there are totally three accused persons, these petitioners were arrayed as Accused Nos.1 & 2. The petitioners are innocent persons and they have not committed any offences as alleged by the prosecution. The petitioners are ready and willing to abide any 2/6
conditions that may be imposed by this Court. He would further submit that the petitioners/Accused Nos.1 & 2 are in judicial custody from 05.08.2025 nearly 24 days. Hence, he seeks bail.
4. The learned Government Advocate (Criminal Side) would submit that there are totally 3 accused persons. These petitioners are arrayed as A1 and A2. Due to the family dispute these petitioners and other accused persons were entered into the house of the defacto-complainant and attacked the defacto-complainant and her family members and abused her with filthy language and threatened her with dire consequences. In this case, A3 was arrested and enlarged on bail by the learned Principal District and Sessions Judge, Pudukottai in CrlMP.No.2378 of 2025 dated 25.08.2025. The first petitioner is having two previous cases, there is no previous case against the second petitioner. However, he objected to grant bail to the petitioners.

Taking into consideration of the facts and circumstances of the case and also taking note of the fact that in this case, the Accused No.3 was enlarged on bail by the leanred Principal District and Sessiosn Judge, Pudukottai in CrlMP.No.2378 of 2025 dated 25.08.2025, by this time most of the investigation might have been completed, there is no previous case against the second petitioner, the petitioners/accused Nos.1 & 2 are in judicial custody from 05.08,2025, taking into consideration of the 3/6
period of incarceration, this court is inclined to grant bail to the petitioners, subject to the following conditions:

Accordingly, the petitioners are ordered to be released on bail on executing separate bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties, each for a like sum to the satisfaction of learned District Munsif cum Judicial Magistrate Court, Alangudi and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.
[b] The petitioners shall furnish their residential address and contact number to the learned District Munsif cum Judicial Magistrate Court, Alangudi. If the petitioners changes their residential address, they shall report the same to the learned District Munsif cum Judicial Magistrate Court, Alangudi; [c] the first petitioner shall appear and sign before the respondent police daily twice at 10.00a.m. and 05.00p.m. until further orders; the second petitioner shall appear and sign before the respondent police daily at 10.30.a.m. Until further orders. [d] the petitioners shall not abscond either during investigation or trial. [e] the petitioners shall not tamper with evidence or witness either during investigation or trial.

[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji .vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
