To set aside the impugned order passed by the 1st respondent in Na.Ka.No.12959/N4/2018 dated 22.05.2023 by allowing this appeal. ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.P.ALWIN BALAN, Advocate for the petitioner and of MR.M.N.MUTHUVIJAYAN, Special Government Pleader on behalf of the Respondents, the court made the following order:- This Civil Miscellaneous Petition is filed to condone the delay of 33 days in filing the above appeal.
2.It is the submission of the learned counsel for the petitioner that his Clerk misplaced the certified copy of the impugned order in the advocate office and after persistence search, it was retrieved on 22.08.2023. Thus, there is a delay of 33 days in filing the appeal.
3.Considering the reasons stated for the delay of 33 days in filing the appeal and having satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed on condition that the petitioner shall pay cost of Rs.1,000/- to the account No.7567821433, Indian Bank, High Court Branch, Madurai, for donating law books to a Separate Section in the name of "Madurai Bench of Madras High Court" in Kalaignar Centenary Library, Madurai. 2/4
