PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to conclude the enquiry initiated against the petitioner in pursuant to the charge memo dated 14.02.2023 on the file of the first respondent within a time stipulated by this Court.

O R D E R

The present writ petition has been filed by seeking for Writ of Mandamus, directing the respondents 1 and 2 to conclude the enquiry initiated against the petitioner in pursuant to the charge memo dated 14.02.2023, on the file of the first respondent within a time stipulated by this Court.

2. The writ petitioner is a Head Constable seeking a direction to complete the enquiry which was initiated by way of charge Memo dated 14.02.2023. The writ petitioner had earlier filed the writ petition in W.P.(MD) No.5496 of 2023 seeking a Mandamus to revoke the order of suspension. In the said writ petition, this Court, by an order dated 14.03.2023 had directed the authority to complete the disciplinary proceedings on merits and in accordance with law within a period of three months from the date of receipt of a copy of the order.

3. In the said writ petition, the learned counsel appearing for the petitioner has given an undertaking that he would offer an explanation at earliest. Now, the present writ petition has been filed for expeditiously conclusion of the enquiry. From the typed set of papers, it could be seen that the writ petitioner has so far not submitted his explanation for the charge Memo issued to him on 14.02.2023.

4. In case, if the writ petitioner submits his explanation on or before 17.10.2023, the authorities are directed to complete the enquiry within a period of three months from the date of receipt of submission of the explanation.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
