PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondents No.1 and 2 to instruct the respondent No.3 for not to harass the petitioner on the guise of enquiry.

ORDER

This Criminal Original Petition has been filed to direct the respondents No.1 and 2 to instruct the respondent No.3 for not to harass the petitioner on the guise of enquiry.

2. The petitioner is the owner of the property. On the basis of the complaint given by one Athirstarajan, frequent summons were issued to the petitioner that he is interfering into the civil issue.

3. The learned Government Advocate (Crl.Side) would submit that even though the summon issued to the petitioner, he has not appeared before the third respondent so far.

4. Let the petitioner appear before the third respondent and produce the documents showing ownership of the property. If it is found during the course of enquiry that it is the civil issue, the third respondent may close the above said complaint, advising the parties to workout their remedy through appropriate proceedings.

5. With the above said direction, this Criminal Original Petition is disposed of.
