2.It is submitted by the learned counsel for the petitioner that the petitioner, who has been running the footwear shop, has borrowed a loan from the third respondent financial company and on account of the drainage work being undertaken in Trichy City, the shop of the petitioner was closed, thereby he could not pay the EMIs regularly, on account of which the third respondent has employed the fourth respondent as a collection agent, who has been threatening the petitioner even during night time asking the petitioner to pay installments. 2/5

3.The learned Government Advocate (Crl.side) submits that the representation of the petitioner has been received by post without signature, thereby the police could not take any action and if the petitioner files a fresh application duly signed with all the relevant documents, then the police would take appropriate action.

4.Considering the submissions made by the learned counsel on either side and on perusal of the records, this Petition is disposed of directing the petitioner to file a fresh application duly signed, on which the respondent police are directed to make an enquiry and complete the same as expeditiously as possible, not later than two weeks from the date of receipt of a copy of this order.
