O R D E R

This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents to promote the petitioner to the post of driver along with consequential benefits by considering the petitioner's representation dated 26.07.2025, within the time stipulated by this Court. 2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner has been working as a Sanitary Worker in the third respondent Corporation since the year 2001. Subsequently, based on the first respondent's order dated 2/6

09.01.2024, a list of eligible employees was published across 138 municipalities in the State of Tamil Nadu for the post of Sanitary Supervisor. In the said list, the petitioner was ranked fifth. However, pursuant to the order dated 25.04.2025, passed by the third respondent, the petitioner was temporarily transferred to the position of Driver. Thereafter, the petitioner submitted a representation dated 26.07.2025 to the respondents seeking promotion to the post of Driver along with consequential benefits, on priority, as per the Tamil Nadu Urban Local Bodies Finances (Amendment) Act 2023, dated 04.03.2025 and the circular dated 30.05.2025. As no action was taken on the representation, the petitioner has filed the present writ petition before this Court.

4. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the third respondent to consider the representation of the petitioner dated 26.07.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.

5. Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the third 3/6

respondent, to consider the representation of the petitioner dated 26.07.2025 and pass appropriate orders in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.
