O R D E R

Heard the learned counsel for the petitioner, the learned Central Government Standing Counsel for the first respondent and the learned Government Advocate (Criminal Side) for the second and third respondents.

2. The petitioner has filed this Writ Petition for the issuance of a Writ of Mandamus, directing the first respondent to renew her husband's passport bearing Passport No.N5184813, based on the petitioner's representation dated 25.08.2025.

The learned Government Advocate (Criminal Side) for the second and third respondents submits that the petitioner's husband has been proceeded against in connection with a First Information Report (FIR) in Crime No.393 of 2024 registered by the third respondent on 21.09.2024 for offences punishable under Sections 296(b), 118(1), 324(2), Page No. 2 of 6

and 351(3) of the Bharatiya Nyaya Sanhita, 2023 read with Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002.

4. He further submits that although First Information Report has been registered against the petitioner's husband, the case is still under investigation and no charge sheet has been filed against the petitioner.

5. The petitioner is the wife of M.Chandran and has filed this writ petition on behalf of her husband. It is noticed that the petitioner's passport, which was issued on 07.02.2016, is valid until 16.02.2026. On being queried as to why the petitioner's husband has applied for renewal at this stage, the learned counsel for the petitioner submitted that the petitioner's husband was employed abroad and that his visa had expired. He further submitted that since the passport is required to have a minimum validity of five years for the purpose of visa renewal, a renewal of the passport for a further period of ten years is necessary, at this stage itself.

6. Apart from that, the petitioner's husband is stated to be involved in a criminal case, which led to the registration of an FIR. Considering the Page No. 3 of 6

fact that only an FIR has been registered against the petitioner's husband along with others and that no charge sheet has been filed or taken on file by the jurisdictional court till date, there is no impediment in directing the first respondent to consider the passport application of the petitioner's husband and renew his passport, as prayed for. This exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order.

8. It is made clear that in the event a charge sheet is filed against the petitioner's husband and the same is taken on file by the concerned court, the petitioner's husband shall appear before the court on the first date of hearing.
