PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the learned I Additional District and Sessions Judge (PCR Court), Trichy to consider the bail application of the petitioner on the same day of his surrender itself in Crime No.2228 of 2023 on the file of 2nd Respondent police. For Petitioner :Mr.K.Manoharan For Respondent :Mr.M.Vaikkam Karunanithi Government Advocate (Crl. Side) O RDER This Criminal Original Petition has been filed to direct the learned I Additional District and Sessions Judge (PCR Court), Trichy, to consider the bail application of the petitioner on the same day of his surrender itself in Crime No. 2228 of 2023 on the file of 2nd Respondent Police.

2. The case of the prosecution is that the defacto complainant lodged a complaint stating that his wife is a gradute and looking for Government job. Knowing the above said search, one Thangavel and Kumar approached them and promising to secure the job, they demanded Rs.15,00,000/-. They were taken to one Prince Sivakumar. He also demanded Rs.15,00,000/- for securing the job. 2/4

Rs.5,00,000/- was demanded as advance, that was also given to the above said Prince Sivakumar and documents were received by him. Thereafter, they failed to arrange the Government job. When the money was demanded back, they were criminally intimidated, abused. Seeking direction to the concerned trial Court to consider the bail application on the date of surrender, this petition has been filed, stating that even as per the allegation made in the First Information Report, no overt act is attributed against the petitioner.

3. But however, considering the facts and circumstances of this case and the manner, in which, the above said offences said to have been committed, this petitioner is not entitled for any discretionary relief. The petitioner has to surrender before the respondent Police and co-operate with them to complete the process of investigation.

4. With the above said direction, this Criminal Original Petiton is dismissed.
