PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st respondent to withdraw the pending investigation in Crime No.133 of 2023 dated 07.08.2023 on the file of the 2nd respondent Police based on the representation of the petitioner dated 12.08.2023 and to entrust the same to the 3rd Respondent Police for conducting enquiry within the time stipulated by this Court 1/5
and also to give Police Protection for the petitioner. For Petitioner :Mr.S.Anantha Murugan For Respondent :Mr.Sakthi Kumar Government Advocate (crl.side) O RDER This criminal original petition has been filed seeking direction to the 1st respondent to withdraw the pending investigation in Crime No.133 of 2023 dated 07.08.2023 on the file of the 2nd respondent Police based on the representation of the petitioner dated 12.08.2023 and to entrust the same to the 3rd Respondent Police for conducting enquiry within the time stipulated by this Court and also to give Police Protection for the petitioner.
2.Seeking transfer of investigation on the ground that no proper investigation has been undertaken by the respondent this petition came to be filed. The learned Government Advocate (Crl. Side) would submit that investigation has been been completed and final report has been filed before the Additional Mahila Court, Trichy on 02.09.2023. But, so far it has not been taken on file. 2/5
3.Reading of the CD file does not indicate or support the suspicion that has been entertained by the petitioner. Since the final report has been filed before the concerned Court, after completing the investigation, there is no question of transfer of investigation. Therefore, nothing survives for further adjudication in this petition. If the petitioner still aggrieved by the contents of the final report, he can workout his remedy through appropriate proceedings. 4.With the above said liberty, this criminal original petition stands dismissed.
