Prayer in Crl.A.(MD)No.696 of 2023:- This Petition filed under Section 14-A(2) of the Schedule Caste and the Schedule Tribes (Prevention of Atrocities) Amendment Act, to call for the records pertaining to the order dated 28.07.2023in Crl.M.P.No.684 of 2023 on the file of Sessions Judge, Special Court for Trial of Cases Under SC/ST (POA)Act, Thoothukudi (FAC) and to set aside the same and enlarge the appellant in Crime No.177 of 2023 on the file of the 1st respondent by allowing this Criminal Appeal. 1/4
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. C. Geetha, Advocate for the Petitioner and of Mr. S. Manikandan, Government Advocate for the 1st and 2nd respondents, this Court made the following order: This petition has been filed to relax the condition imposed on the petitioner in Crl.A.(MD)No.696 of 2023 dated 22.08.2023. 2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly. 3.The learned Government Advocate(Crl.Side) appearing for the respondent police submitted that the petitioner has been complying with the condition regularly.
4.Considering the nature of offence, the condition imposed by this court in Crl.A.(MD)No.696 of 2023 dated 22.08.2023 is modified and the petitioner shall report before the first respondent police once in a month i.e on the 1st working day of every English calendar month at 10.30 a.m until further orders.
