PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 2nd respondent not to harass the petitioner based on the complaint submitted by the 3rd respondent under the guise of enquiry.

ORDER
This Criminal Original Petition has been filed to direct the 2nd respondent not to harass the petitioner based on the complaint submitted by the 3rd respondent under the guise of enquiry.
2. The learned Government Advocate (Crl.Side) would submit that it is a matrimonial issue between the husband and wife. Enquiry was conducted in CSR No.306 of 2023. In the above said enquiry, some understanding was reached between the parties, by which, the child was handed over to the defacto complainant.
3. Now the grievance of the petitioner is that the above said undertaking/understanding was reached under force. The second respondent under force, snatched the child from the hand of this petitioner and handed over the same to the third respondent, who is the wife.
4. If the petitioner got any grievance over the custody of the child, he can workout his remedy only through the appropriate proceedings. 2/4
5. With the above said liberty, this Criminal Original Petition is disposed of.
