Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned Order No.27/2025 dated 19.08.2025 passed by the 3rd Respondent and quash the same as illegal and consequently forbearing the respondents 1 to 3 from registering any deed or any other documents in respect of the petitioners joint family property comprised in Survey No.77/6D to an extent of 67 cents, situated at Kavalipatti Village, Thiruvonam Taluk, Thanjavur District, by considering the petitioner's representation dated 19.08.2025. ORDER

Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for the respondents 1 to 3. Issuance of notice to the respondents 4 to 6 is dispensed with. 2/6

2.The petitioner wants this Court to restrain the third respondent from registering any document that may be received from the respondents 4 to 6 in respect of the petition mentioned property. The third respondent has made it clear that the petitioner has to get the relief only from the jurisdictional Court. It is seen that the petitioner has already filed O.S.No.147 of 2025 on the file of the District Munsif Court, Orathanadu. The petitioner has to necessarily get injunction only from the said civil Court. It appears that no interlocutory application has been filed. The petitioner is given liberty to file an IA.

If such an IA is filed within a period of one week from the date of receipt of a copy of this order, it shall be numbered immediately by the trial Court and dispose it of on merits and in accordance with law within a period of four weeks thereafter. If any document is presented in the meanwhile, the registering authority shall keep the same as a pending document and wait for the outcome of the IA. Merely because I have given such a direction, it will not mean that I have expressed anything on the merits of the writ petitioner's claim.

3.This writ petition is disposed of accordingly. No costs.
