O R D E R

Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for respondents 1 to 4.

2. Issuance of notice to the fifth respondent is dispensed with.

3. The petitioner is a resident of Kalkulam Village. She alleges that survey No.141/1 is a water body and that certain private individuals have put up constructions and are obstructing the said water way.

4. Our attention is drawn to the communication of the Revenue Divisional Officer, Sivagangai calling upon the jurisdictional Tahsildar to conduct enquiry on the petitioner's representation.

5. The third respondent shall conduct survey after putting all the parties concerned on notice within a period of four weeks from the date of receipt of a copy of this order. If the outcome of the survey indicates that there are encroachments, due process of law will be followed and after giving due opportunity to all the encroachers, the encroachments will be removed within a period of three months, thereafter.
