ORDER

This writ petition has been filed directing the 1st respondent to re-issue the passport of the petitioner in Application reference No.MD1075461245725 dated 07.08.2025.

Heard Mr.N.Kumar, learned counsel for the petitioner and Mr.P.Sivachandran, learned Central Government Standing Counsel for the first respondent and Mr.S.Prakash, learned Government Advocate [Crl side] for the second respondent.

It is the contention of the petitioner that his application for reissuance of passport has not been acted by the first respondent on the ground of adverse report received from the second respondent. Further it is stated that he has not involved in any offence as alleged by the second respondent.

The learned Government Advocate (Crl.side), on instructions, would submit that FIR in Crime No.561 of 2024 for the offence under Section 303(2) of BNS and Section 21(5) of Mines and Minerals (Development and Regulation) Act, 1957 was registered against the petitioner on the file of the second respondent.

5. In the considered view of this Court, the law on this issue is now too well settled. As per the decision of the Division Bench of this Court in The Regional Passport Officer, Chennai vs. Samsudeen Mohamed Salih and another (W.A. No.902 of 2023 dated 02.06.2023), there can be no impediment to direct the first respondent to act upon the passport application of the petitioner. Hence, there shall be a direction to the first respondent to process the application of the petitioner and re~issue the passport in the name of the petitioner within a period of one month from the date of receipt of a copy of this order, if the petitioner satisfies all the other requirements.
