Respondent PRAYER: Criminal Revision Case has been filed under Section 397 r/w 401 of the Criminal Procedure Code, to set aside the order passed in Crl.R.C.No.8 of 2014 dated 09.08.2016 on the file of the 1st Additional Sessions Court, Tirunelveli modifying the order passed in M.C.No.28 of 2010, dated 10.12.2013 on the file of the Chief Judicial Magistrate Court, Tirunelveli by allowing this Criminal Revision Case.

ORDER

This Criminal Revision Case is filed to set aside the order passed in Crl.R.C.No.8 of 2014 dated 09.08.2016 on the file of the 1st Additional Sessions Court, Tirunelveli modifying the order passed in M.C.No.28 of 2010, dated 10.12.2013 on the file of the Chief Judicial Magistrate Court, Tirunelveli by allowing this Criminal Revision Case.

2.Today, when the matter has been taken up for hearing, the learned Counsel appearing for the respondent submitted that the respondent had died on 01.07.2017 and the learned Counsel appearing for the petitioner has also affirmed the same and therefore, prayed that the revision case be dismissed as abated. 3.In view of the above, recording the above submission made on either side, this Criminal Revision Case is dismissed as abated. Consequently, connected miscellaneous petition is also dismissed.
