ORDER
This Criminal Original Petition has been filed, invoking Section 528 of BNSS, seeking orders, to direct the first respondent to issue Lookout Circular against the third respondent/A4 in connection with Crime No.129 of 2024 on the file of the second respondent based on the petitioner's representation, dated 01.10.2024.
2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that on the basis of the complaint given by the petitioner, FIR came to be registered in Crime No.129 of 2024 for the alleged offence under Sections 294(b), 342, 352, 506(i) and 379 of IPC and that they have examined five witnesses and the investigation is pending.
3. The petitioner has not assigned any valid reason or ground for issuance of Lookout Circular at this stage. Considering the above, this Court is of the view that the very filing of the petition is a clear abuse of process of law and as such, the same is liable to be dismissed. 2/4
