JUDGMENT

The claimant has preferred this Civil Miscellaneous Appeal for enhancement.

2.It is a case of injury. The contention of the claimant is that during the accident, he had several fractures from hip to toe and also had head injury and facial injury. The claimant also underwent seven surgeries. In spite of the same, the Tribunal has granted less compensation. The further contention of the claimant is that he was working as "electrician" hence, with 60% permanent disability, he would not be able to continue his job. The Tribunal has taken only Rs.3,000/- for each percentage of permanent disability, which comes to Rs. 1,80,000/- (Rs.3,000/- * 60). Therefore, this Court is inclined to increase the same from Rs.3,000/- to Rs.4,000/- for each percentage of permanent disability which amounts to Rs.2,40,000/- (Rs.4,000/- * 60) and the same is just and fair compensation.

3.As far the pain and suffering are concerned, this Court is enhancing the same from Rs.40,000/- to Rs.70,000/-. As far as nourishment is concerned, this Court is enhancing the same from Rs.5,000/- to Rs.25,000/-. As far as loss of amenities is concerned, this Court is enhancing the same from Rs.12,250/- to Rs. 27,250/-.

On such deposit, the claimant is permitted to withdraw the same with accrued interests and costs, less the amount already withdrawn by him, if any, by filing appropriate application before the Tribunal.

6.With the above said directions, the Civil Miscellaneous Appeal is partly allowed. No costs.
