Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus, directing the respondents herein to extend the benefits of Additional Fitment table issued in Government vide letter No.51082/Paycell/2010-1 dated 15.09.2010 as per Rule 4(i) & (iii) of the TamilNadu Revised Scale of Pay Rules, 2009 and consequently revise the pensionary benefits of writ petitioner with all monetary benefits by considering the representation dated 10.09.2024 given by the writ petitioner. The present writ petition has been filed seeking direction to the respondents herein to extend the benefits of Additional Fitment table issued in Government vide letter No.51082/Paycell/2010-1 dated 15.09.2010 as per Rule 4(i) & (iii) of the TamilNadu Revised Scale of Pay Rules, 2009 and consequently revise the pensionary benefits of writ petitioner with all monetary benefits by considering the representation dated 10.09.2024 given by the writ petitioner. 2/4
2. Considering the fact that the Divison Bench of this Court in a batch of writ appeal in WA(MD).No.468 of 2025 etc., batch cases dated 29.08.2025 had considered the very same issue and had set aside the similar directions given by the learned single judge.
3. Therefore, this Court is of the view that a Mandamus as prayed for by the petitioner in the present writ petition cannot be granted, as the judgement of the Division Bench of this Court is binding upon this Court.
