ORDER

(Order of the Court was made by the Hon'ble the Chief Justice) As against the allegation of encroachment, learned State counsel is not in a position to dispute that, upon survey conducted, encroachment of land classified as "Natham" has been found. If that is so, we fail to understand as to what preventive steps or action was taken for removal of encroachment.

2. The State is entitled to proceed further in the matter as per the provisions of the Tamil Nadu Land Encroachment Act and conclude the proceedings within a period of three months from today.

The person against whom action is proposed to be taken, however, shall be entitled to an opportunity of hearing. The writ petition is disposed of. However, there shall be no order as to costs.
