This Criminal Revision Petition has been filed, challenging the order, condoning the delay in filing a complaint in S.T.C.No....of 2014, on the file of the learned Judicial Magistrate No.1, Ramanathapuram.
2.The respondent herein filed a private complaint under Section 138 of Negotiable Instruments Act with a delay of 17 days in filing the private complaint. The Court below condoned the delay. Challenging the above order, the present petition has been filed.
3.I have heard Mr.T.R.Jeyapalam, learned counsel appearing for the petitioner and Mr.J.M.Hassnul Bazzari, appearing for the respondent and perused the records carefully. 4.The delay is only 17 days in filing the complaint and being satisfied with the reasons for the delay, the Court below exercised its discretion and condoned the delay. I have also carefully considered the materials available on record. I find that there are sufficient reasons stated for the delay. Apart from that, the lower court also exercised its discretion and condoned the delay. There is no reason to interfere with the order passed by the court below. 4.In fine, this Criminal Revision Case is dismissed. Consequently, connected miscellaneous petition is also dismissed.
