ORDER

The petitioners/A-2, A-4 & A-5, who apprehends arrest at the hands of the respondent police for the alleged offences under Section 120B read with 1/4

420, 467, 468, 471 of IPC and Section 13(2) read with 13(1)(a) of Prevention of Corruption Act, 1988 (as amended in 2018), in FIR No.RC2292025A0002, seeks anticipatory bail.

2. The case of the prosecution is that the accused persons offered collateral securities for obtaining a loan from the State Bank of India, and the said properties are public park lands. The accused persons allegedly fabricated government revenue records and fraudulently created title deeds, which they dishonestly submitted as collateral security to SBI for availing cash credit loan facilities, thereby defrauding the State Bank of India and causing wrongful loss to the Bank and wrongful gain to themselves. Hence, a case has been registered as against the petitioner.

3.The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they have not committed any offence. He seeks this Court to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl. side) appearing for the respondent strongly objected to grant anticipatory bail to the petitioners and submitted that Ponravi and Ponraghu had executed a mortgage deed with SBI. 2/4

5. Considering the facts of the case, this Court had already granted interim anticipatory bail to the petitioners. In the meantime, Ponravi and Ponraghu were arrested in another case and are still in custody. They had executed the mortgage with the Bank despite not being the owners of the property. Therefore, insofar as petitioners 2 and 3 herein (A-4 and A-5) are concerned, this petition is dismissed. As far as the first petitioner (A-2) is concerned, this Court is inclined to grant anticipatory bail with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the II Additional District Judge for CBI Cases, Madurai, within a period of fifteen days from the date of receipt of a copy of this order and on further conditions that: [a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall report before the respondent police as and when required for interrogation.

[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioner shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
