2. The appellant herein is figured as fourth respondent in the writ petition. The appellant has a stake in the matter. But without notice to him, the writ petition was disposed of. Aggrieved by the same, this writ appeal has been filed.

3. We are clearly of the view that the writ petition could not have been disposed of without hearing the appellant. In this view of the matter, the order dated 30.08.2022 made in W.P.(MD)No.18249 of 2022 is set aside. The matter is remanded to the file of the learned Single Judge. The matter will be heard afresh. The learned counsel for the appellant states that he would forthwith enter appearance and also file a counter affidavit within a period of four weeks from the date of receipt of a copy of this order.
