ORDER

Challenge has been made to the order passed by the first respondent in Moo.Mu.M.R/11988/2023 dated 09.01.2024 directing the respondents therein to pay a sum of Rs.1,000/- each to their mother, namely, Ramalakshmi.

2. Heard both sides. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioners that the second respondent is their mother and she filed an application before the first respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, wherein the first respondent directed the respondents therein to pay a sum of Rs.1,000/- each as monthly maintenance to the petitioner therein. Aggrieved by the same, this petition has been filed. It is the contention of the petitioners that the second respondent herein is in possession of 3.69 acres of agricultural land, that apart, she is also earning under the 100 days National Rural Employment Scheme. Therefore, according to the petitioners, they are willing to pay a sum of Rs.500/- each as monthly maintenance to the second respondent herein. Page No.2/4

Having regard to the factual findings that the petitioner in Moo.Mu.M.R/11988/2023 is still holding 3.69 acres of agricultural land, this Court directs the respondents therein to pay a sum of Rs.500/- each as monthly maintenance to the second respondent. If the amount has not been paid, the petitioners will be prosecuted as per Section 24 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 18.10.2024 (2/2) Index :
