PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned proceedings in Na.Ka.370/KA.AA.Thi.Na/23, dated 23.09.2023 of the second respondent by rejecting the permission for conducting cultural programme, namely, "Adal Padal" and quash the same and further direct the second respondent to grant permission for conducting cultural programme, namely, "Adal Padal" to be held on 27.09.2023, Wednesday, at Sengulam Village, Madurai District in the eve of Arulmighu Sri Ayyanar, Sri Veyil Ugantha Amman and Sri Muthaiah Temple Festival. This writ petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent Police to grant permission for conducting of Adal Padal programme at Sengulam Village, Madurai District, in the eve of Arulmighu Sri Ayyanar, Sri Veyil Ugantha Amman and Sri Muthaiah Temple Festival, by setting aside the impugned order passed by the second respondent in Na.Ka.370/KA.AA.Thi.Na/23, dated 23.09.2023.

2. It is submitted by learned counsel for the petitioner that for the last four decades, the villagers have been conducting the Adal Padal without any untoward incidents, however, the respondent Police have rejected the permission. Therefore, sought for suitable directions.

3. Learned Government Advocate (Criminal Side) submits that this year, during the course of festival, the disputes arose between the petitioner's group and the rival group and thereby, yesterday i.e., 26.09.2023, an incident has happened, basing on which, a criminal case has also been registered. It is submitted that, in case, if permission is granted, the said disputes will again escalate and it may likely to lead law and order problem. 2/4

4. In view of the submissions made by both the parties, as the situation is not conducive to conduct program like Adal Padal, this writ petition is dismissed. No costs.
