Prayer in Crl.A(MD) No.650 of 2023 This Criminal Appeal is filed under Section 14-A(2) of the Schedule Caste and the Schedule Tribes (Prevention of Arocities) Amendment Act, to call for the records relating to the order in Crl.M.P.No. 2200 of 2023 dated 25.07.2023 on the file of the III Additional District and Sessions Court,(PCR Cases), Madurai, and the set aside the sdame and grant bail to the Appellant by allowing this Criminal Appeal. Order : This Criminal Miscellaneous petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.POORNACHANDRAN.S, Advocate for the petitioner and Mr.Manikandan Government Advocate for the first and second respondents, this court made the following order: This petition has been filed to relax the condition imposed on the petitioner/accused in the order dated 08.08.2023 passed by this Court in the above Criminal Appeal.
2. The petitioner/accused was ordered to be released on bail on 08.08.2023 with specific condition that the petitioner/accused shall appear before the respondent police daily at 10.30 a.m. until further orders. The learned counsel for the petitioner/accused would submit that the petitioner/accused is abiding the 2/4
condition regularly till date and therefore pray for relaxation of the said condition.
3. The learned Government Advocate (Criminal Side) appearing for the first and second respondents would submit that except one day, i.e. on 20.09.2023, the petitioner/accused abided the condition imposed on him by this Court in the above Criminal Appeal regularly.
4. Considering the above facts and circumstances of the case and considering the fact that the petitioner/accused is abiding the condition imposed on him, this Court is inclined to relax the condition. Accordingly, the condition is relaxed and the petitioner/accused is directed to appear before the Trial Court on receipt of summons.
